The Site describes marketplace operating and consulting services, including an initial "Operator Audit" and, where a fit is agreed, ongoing management of a client's marketplace account (collectively, the "Services"). Any Services beyond browsing the Site — including a consultation, audit, or ongoing engagement — are subject to a separate written agreement between you and Level Up Ecomm, which will govern the scope, fees, and terms of that engagement. These Terms govern your use of the Site itself and apply to any such engagement except where the separate agreement expressly states otherwise.
The Site and Services are intended for businesses and individuals acting in a business capacity who are at least 18 years old and have the authority to bind the business they represent. By using the Site, you represent that you meet these requirements.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
Submitting the form on this Site to request a consultation does not create a client relationship, obligate either party to proceed, or entitle you to any specific outcome. Whether to proceed with an audit or ongoing engagement is at the mutual discretion of the parties, and any paid engagement begins only once both parties agree to its terms in writing.
Statements on this Site about the founder's own business results, growth, or methodology describe past outcomes for that specific business and are provided for illustrative purposes. They are not a promise, guarantee, or prediction of any particular revenue, profit, ranking, or growth outcome for your business. Marketplace performance depends on factors outside our control, including platform policies, competition, market conditions, and your own business operations. Any figures, case studies, or examples referenced on the Site are not a guarantee that you will achieve similar results.
The Site and its content, including text, graphics, logos, and design, are owned by Level Up Ecomm or its licensors and are protected by intellectual property laws. You may view and use the Site for your own informational purposes but may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written consent.
The Site uses third-party services, including but not limited to Google Tag Manager, Meta (Facebook) Pixel and Conversions API, and GoHighLevel, to operate forms, measure advertising performance, and manage inquiries. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, LEVEL UP ECOMM LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). You agree to indemnify and hold harmless Level Up Ecomm LLC and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state or federal courts located in Wyoming, and you consent to personal jurisdiction and venue there.
We may update these Terms from time to time. Changes take effect when we post the updated Terms on this page with a revised effective date. Your continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
